ChkM8 Terms and Conditions

Effective Date:  January 24, 2026

These Terms and Conditions (“Terms”) govern your access to and use of the ChkM8 mobile application, website, and related services (collectively, the “Services”). By creating an account, accessing, or using ChkM8, you agree to be bound by these Terms.

If you do not agree, do not use the Services.

1. Platform Purpose and Scope

ChkM8 provides a technology platform that enables users to submit and receive post-interaction ratings. The platform is designed to promote accountability and awareness but does not prevent, predict, verify, or guarantee behavior.

ChkM8 is not:

  • A safety service
  • A law enforcement tool
  • A certification authority
  • A background check provider
  • A guarantor of conduct or outcomes

2. No Guarantee of Safety or Conduct

You acknowledge and agree that:

  • ChkM8 does not guarantee your safety or the behavior of any individual or group
  • Ratings reflect subjective user opinions and experiences
  • No rating, score, badge, or designation should be relied upon as an assurance of safety

Participation in any event, gathering, or interaction is entirely at your own risk.

3. Ratings and Scores

A. Nature of Ratings

  • Ratings are user-generated opinions compiled from feedback voluntarily submitted by users.
  • Ratings are not statements of fact
  • Ratings are not verified by ChkM8

B. Composite Scores

  • ChkM8 generates composite or algorithmically weighted scores based on user inputs
  • Individual ratings are not disclosed
  • Scores are informational only

C. No Publication or Endorsement

ChkM8 does not publish, distribute, or promote individual ratings. Any disclosure of composite scores to third parties is initiated voluntarily by users at their sole discretion.

4. Group Programs and Designations

Some organizations may register for group-based programs administered by ChkM8, including but not limited to the Greek Safety Program (“GSP”).

Safe House Designation

The term “Safe House” refers solely to an organization’s satisfaction of participation requirements established by ChkM8, including member engagement and rating participation thresholds. A “Safe House” designation:

  • Reflects participation and program compliance, not behavioral outcomes
  • Is not an aggregated safety rating of all members of the organization
  • Is not a determination that any individual, event, or organization is safe
  • Does not represent a consolidated group rating or guarantee of conduct
  • Utilizes aggregated rating activity, if at all, only as an informational input and not as a certification
  • Is not an endorsement, certification, or guarantee by ChkM8

No Reliance on Third-Party Statements

ChkM8 does not control, verify, or endorse how organizations or their members describe registration, participation, or any designation associated with group-based programs. Users acknowledge and agree that any statements made by third parties regarding “Safe House” status are not authorized representations by ChkM8 and may not be relied upon as assurances of safety or behavior.

Each individual remains solely responsible for their own conduct at all times.

5. User Responsibilities

You agree that:

  • You are responsible for your own safety, conduct, and decisions
  • You will not rely on ChkM8 ratings as assurances of behavior
  • You will use the Services in good faith and not manipulate ratings
  • You will not misuse the platform to harass, threaten, or defame others

6. Account Eligibility

You must be at least 18 years old to use ChkM8.

By creating an account, you represent that:

  • You meet eligibility requirements
  • Information you provide is accurate to the best of your knowledge
  • You are not using the platform to evade prior ratings or restrictions

7. Account Closure and Data Deletion

A. Closing an Account

Users may close their account without immediately deleting associated data. If a user re-registers within sixty (60) days of account closure, previously associated data and ratings may be restored. If a user does not re-register within this period, associated data and ratings may be permanently deleted in accordance with ChkM8’s data retention policies.

B. Deleting an Account

Users may request permanent deletion of their account and data. This action is irreversible.

C. Device-Based Restrictions

To preserve platform integrity:

  • ChkM8 may restrict the ability to create a new account on a device previously used to delete an account
  • This includes situations where deletion was initiated after receiving unfavorable ratings
  • These measures are applied solely for platform integrity and abuse prevention purposes and are not used for advertising or cross-service tracking

Device restrictions may persist even if ownership of the device changes.

8. No Right to Appeal or Modify Ratings

Users acknowledge and agree that:

  • Ratings are not subject to appeal, correction, or removal
  • ChkM8 does not adjudicate disputes regarding ratings
  • Ratings are expressions of opinion, not factual claims

9. Prohibited Conduct

You may not:

  • Manipulate or coerce ratings
  • Create multiple accounts to evade restrictions
  • Misrepresent ratings or platform designations
  • Use ChkM8 for unlawful purposes
  • Attempt to reverse engineer or interfere with platform algorithms

ChkM8 may suspend or terminate accounts for violations.

10. Limitation of Liability

To the maximum extent permitted by law:

  • ChkM8 shall not be liable for personal injury, assault, harassment, or misconduct
  • ChkM8 shall not be liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed the total amount actually paid by the specific user bringing the claim to ChkM8, if any, for use of the Services during the twelve (12) months immediately preceding the event giving rise to that user’s claim.

11. Indemnification

You agree to indemnify and hold harmless ChkM8, its officers, directors, employees, and affiliates from any claims arising out of:

  • Your use of the Services
  • Your interactions with others
  • Your participation in group programs
  • Any violation of these Terms

12. Dispute Resolution and Arbitration

Any dispute arising out of or relating to these Terms or the Services shall be resolved by binding arbitration, except where prohibited by law.

Arbitration shall be conducted on an individual basis in Travis County, Texas, under the rules of the American Arbitration Association, unless otherwise required by applicable law

Class actions are waived to the extent permitted by law.

13. Modifications to Terms

ChkM8 may update these Terms at any time. Continued use of the Services constitutes acceptance of the revised Terms.

14. Governing Law 

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
